Powerex Corp. (Powerex
) is committed to protecting personal information that is provided to Powerex. Except as it relates to employees, Powerex does not collect, use or disclose personal information from any individual to conduct its business, and will only collect, use or disclose personal information as set out in this policy.
What is personal information?
In this policy, “personal information” means information about an identifiable individual, and may include such information as that individual's name, home address or social insurance number. Personal information does not include information that would enable an individual to be contacted at a place of business, such as name, position name or title, business telephone number, business address, business email or business fax number. How does Powerex collect, use and disclose personal information in the ordinary course of business?
Powerex does not require personal information from any individual to conduct its business, except from employees. Employee personal information is not addressed in this policy. Powerex is required to obtain consent from an individual in the event Powerex collects, uses or discloses that individual’s personal information, except in circumstances where under applicable law consent is deemed to have been provided or consent is not required. Each of these exceptions is discussed below. When is consent deemed to have been provided?
An individual will be deemed to consent to the collection, use and disclosure of personal information by Powerex if the purpose would be considered to be obvious to a reasonable person at the time of deemed consent, and the individual voluntarily provides the personal information to Powerex for that purpose.
For example, consistent with industry practice, as a power marketer Powerex records telephone conversations in respect of its trading activity. Such recordings may be made, used or disclosed to:
- Comply, and demonstrate compliance, with applicable regulatory obligations
- Confirm Powerex business transactions for various purposes, such as proof of the terms of the transaction, and proof of conduct
- Facilitate Powerex’s internal business processes, such as monitoring system performance
- Facilitate legal or regulatory proceedings involving Powerex or a Powerex employee
If an individual voluntarily provides personal information on a recorded call, the individual will be deemed to consent to the collection, use or disclosure of personal information by Powerex. When is consent not required?
Powerex may collect, use or disclose personal information without an individual’s express consent in circumstances in which the collection, use or disclosure is required or authorized by law; the disclosure is for the purpose of complying with a subpoena, warrant or order issued or made by a court, person or body with jurisdiction to compel the production of the information; or the disclosure is made to Powerex’s legal counsel. How does Powerex maintain personal information?
Powerex protects personal information in its custody or under its control by ensuring security arrangements are in place to prevent unauthorized access, to collection, use, disclosure, copying, modification or disposal of such information. Powerex will retain such information only until it is no longer necessary for legal or business purposes. How can I access my personal information?
Individuals may request access to their personal information by providing such request in writing to the Powerex privacy officer at the contact information below, with detail sufficient to enable Powerex to identify the individual and the information sought. Powerex will provide the information within 30 days or will provide written notice of any extension required. Powerex may deny access in the event that the information is protected by solicitor-client privilege, or the disclosure of the information would reveal confidential commercial information that if disclosed, could harm the competitive position of Powerex. In the event that a request for information is refused, Powerex will provide written reasons for any refusal and information in respect of any recourse which may be available.
